Organize for Impact: Legalize Your Group’s Vision and Collective Goals

A Society is an association of individuals combined using a scientific, literary, or charitable purpose. It is one of the most flexible and democratic ways to form a Non-Profit Organization (NPO). Whether you are forming a Residential Welfare Association (RWA), a Sports Club, or a Cultural Group, registering as a Society provides a formal legal structure to manage funds and activities collectively. At Samyuta Tax Consultancy, we provide expert guidance to help you navigate the state-specific regulations and get your Society registered without any legal hurdles.

What is a Society?

A Society is formed when a group of people (Minimum 7 for a State-level Society, 8 or more for National-level) come together for a common non-commercial purpose. Unlike a Trust, which is usually managed by a few Trustees, a Society is managed by a Governing Body or Management Committee elected by its members. This makes it a highly democratic and transparent organization.

Key Advantages of Society Registration

  • Separate Legal Entity: Once registered, a Society can buy, hold, and sell property in its own name. It can also file legal cases and be sued as a corporate body.
  • Democratic Management: Decisions are made through meetings and voting, ensuring every member has a voice in the organization’s growth.
  • Limited Liability: The members of the society are personally protected. They are not held liable for the debts or liabilities of the society beyond their membership fees.
  • Tax Benefits: Much like Trusts and Section 8 Companies, Societies can apply for tax exemptions under Section 12A and 80G of the Income Tax Act.
  • Government Grants: Registered societies are eligible to receive government funding, subsidies, and land at concessional rates for social activities.

Essential Documents for Society Formation

To ensure a successful application with the Registrar of Societies, we require the following details:

From the Members (Minimum 7):

  • Identity Proof: PAN Card and Aadhaar Card of all founding members.
  • Address Proof: Voter ID, Passport, or Driving License.
  • Photographs: Passport-size photos of all members of the Governing Body.

Core Documents (Prepared by Samyuta):

  • Memorandum of Association (MOA): Outlining the Society’s name, objects, and the names of the governing body members.
  • Rules and Regulations: The “Bye-laws” that define how meetings are held, how members are admitted, and how elections are conducted.
  • Affidavit & Declaration: Legal declarations signed by the President or Secretary of the Society.

Office Address Proof:

  • Utility Bill: Electricity or Water Bill of the registered office.
  • NOC: A No Objection Certificate from the landlord of the premises.

The Registration Process: How We Work

  1. Name Selection: We help you choose a unique name that complies with the Emblems and Names Act.
  2. Drafting Bye-laws: Our legal team drafts a robust MOA and Rules & Regulations that suit your specific activities (e.g., RWA, NGO, or Club).
  3. Documentation & Signature: We organize the documentation and ensure all founding members sign the necessary papers in the correct format.
  4. Submission to Registrar: We file the application with the District Registrar of Societies and handle any queries or clarifications raised by the department.
  5. Certification: We deliver the official Certificate of Registration, marking the legal birth of your Society.
